About Eminent Domain And Zoning

The government’s authority to appropriate private land has long been controversial. Eminent domain, sometimes called “appropriation of real estate,” allows government bodies to take ownership of your land in exchange for fair compensation. This process is provided for in the Fifth Amendment to the U.S. Constitution.

Although controversial, the implementation of eminent domain is a common practice. But that doesn’t mean property owners have no rights. If you are a landowner seeking to challenge either the seizure of your property or the compensation being offered, you need the help of an experienced attorney.

I am attorney George E. Pattison, and throughout my career, I have gained extensive experience in eminent domain actions on both sides of the courtroom, representing government and private property owners. My past experiences litigating cases for the government have allowed me to see cases from all angles. Now, in my private practice, I use those skills and experiences to help Ohio residents protect their property and fight for better compensation. I also represent clients facing zoning disputes related to their property.

Legal Procedures And Common Outcomes

While it is possible in some cases to block the government’s seizure of private property, stopping eminent domain altogether is somewhat rare. As such, most cases are focused on compensation.

There are two considerations when it comes to compensation. The first is: What is the monetary value of the land being taken? The second is: What type of damage will the seizure cause to the “residue,” or remaining property? Compensation offers are supposedly made in light of these two considerations, but it should come as no surprise that initial offers are likely to be lower (sometimes much lower) than the property is worth.

As a lawyer with extensive eminent domain experience, I regularly call on the expertise of independent appraisers and cite relevant legal opinions to argue for better compensation for my clients. Once attorneys get involved, the government may offer a higher settlement amount, but I am fully prepared to take a case to trial if that amount is still too low. I have been able to obtain better settlements and compensation amounts for many clients.
