The government’s authority to appropriate private land has long been controversial. Eminent domain, sometimes called appropriation of real estate, allows government bodies to take ownership of your land in exchange for fair compensation. This process is provided for in the 5th Amendment to the U.S. Constitution.

There are two considerations when it comes to compensation. The first is: What is the monetary value of the land being taken? The second is: What type of damage will the seizure cause to the “residue,” or remaining property? Compensation offers are supposedly made in light of these two considerations, but it should come as no surprise that initial offers are likely to be lower (sometimes much lower) than the property is worth.
